By accessing or using CrashStory ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. CrashStory is operated by CrashStory ("we," "our," or "us").

2. Description of Service

CrashStory is an information platform that provides:

Search and visualization of Colorado car accident data sourced from public records maintained by the Colorado Department of Transportation (CDOT).
A directory of personal injury attorneys licensed in Colorado who have opted to be listed on our platform.
Tools for submitting case details and receiving settlement value estimates.
A matching system that connects accident victims with attorneys based on location, case type, and specialty.
Educational content about car accidents, insurance claims, and legal processes in Colorado.

CrashStory is NOT a law firm and does NOT provide legal services.

3. Not Legal Advice

CrashStory is not a law firm and does not provide legal advice. All information on this site, including but not limited to crash data, settlement estimates, case evaluations, and educational articles, is for general informational purposes only and should not be construed as legal advice. The use of this site does not create an attorney-client relationship between you and CrashStory.

If you need legal advice, you should consult directly with a licensed attorney. Communication through this platform with a listed attorney does not establish an attorney-client relationship until the attorney agrees to represent you and you enter into a separate engagement agreement.

4. No Attorney-Client Relationship

Your use of CrashStory, including submitting case information, using the settlement calculator, or communicating with attorneys through the platform, does not create an attorney-client relationship. An attorney-client relationship is only formed when:

An attorney agrees to represent you after reviewing your case.
You and the attorney execute a written engagement or retainer agreement.
Both parties agree to the terms of representation.

5. Attorney Directory

Our attorney directory lists lawyers who have opted to be included and pay for a subscription to our platform. CrashStory does not endorse, recommend, or guarantee the quality, competence, or suitability of any attorney listed.

Attorney listings and profiles may constitute attorney advertising under Colorado Rules of Professional Conduct. The inclusion of an attorney in our directory does not imply any rating, endorsement, or recommendation by CrashStory. Past results of listed attorneys do not guarantee future outcomes. Each legal case is unique, and outcomes depend on the specific facts and circumstances involved.

6. User Responsibilities

You agree to:

Provide accurate and truthful information when submitting cases or creating an account.
Keep your account credentials secure and not share them with others.
Use the Service only for lawful purposes.
Not submit false or misleading accident claims or case information.
Not impersonate another person or misrepresent your identity or affiliation.

You agree not to:

Scrape, crawl, or automate access to the Service beyond normal usage.
Attempt to access restricted areas, other users' accounts, or private data.
Distribute malware or interfere with the Service's operation.
Use the Service to harass, threaten, or harm any individual or entity.
Reproduce, redistribute, or commercially exploit our proprietary content without permission.

7. Crash Data Accuracy Disclaimer

While we strive to present accurate information, crash data displayed on CrashStory is sourced from public CDOT records and may contain errors, omissions, delays, or inaccuracies. We do not guarantee the accuracy, completeness, or timeliness of any data displayed on the Service.

Statistics, rankings, dangerous road assessments, and visualizations are derived from available data using automated processes and should be used for informational purposes only. Do not make legal, insurance, medical, or safety decisions based solely on data from CrashStory.

8. Settlement Calculator Disclaimer

The settlement value estimates provided by our case value calculator are rough approximations only. They are generated using statistical models and publicly available data, and do not constitute legal advice, a guarantee of recovery, or a professional case evaluation.

Actual settlement or verdict values can vary significantly based on jurisdiction, specific facts, evidence quality, insurance coverage, comparative fault, and many other factors that our calculator cannot assess. You should consult a licensed personal injury attorney for an accurate evaluation of your specific case.

9. Intellectual Property

The CrashStory name, logo, website design, original content, software code, and proprietary algorithms are protected by copyright, trademark, and other intellectual property laws. Public crash data from CDOT is not owned by CrashStory.

You may not reproduce, distribute, modify, or create derivative works from our proprietary content without prior written permission. Limited, non-commercial use of crash data for personal reference is permitted.

10. Account Terms

You must be at least 18 years old to create an account.
You are responsible for maintaining the security of your account credentials.
You are responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms, are used for fraudulent activity, or are inactive for an extended period.

11. Attorney Subscription Terms

Attorneys who subscribe to CrashStory for listing and lead access agree to additional terms including:

Maintaining an active Colorado bar license in good standing.
Providing accurate professional information in their profile.
Responding to leads in a timely and professional manner.
Complying with Colorado Rules of Professional Conduct regarding advertising and solicitation.
Payment of subscription fees as agreed at the time of registration.

12. Limitation of Liability

To the maximum extent permitted by law, CrashStory and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

Damages resulting from reliance on information provided through the Service.
Damages arising from the actions or omissions of attorneys listed on the platform.
Loss of data, revenue, profit, or business opportunities.
Service interruptions or data inaccuracies.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

14. Indemnification

You agree to indemnify and hold harmless CrashStory, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles. Any disputes arising from or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Denver County, Colorado. You consent to the personal jurisdiction of such courts.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with an updated "Last updated" date. For material changes, we may also notify registered users via email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
