Subpar Representation Accompanied by False Promises To the overly confident attorneys: it’s one thing to under-promise and over-deliver, but quite another to over-promise and under-deliver. Disappointing doesn’t even begin to describe it. Our case, handled by Underwood Law Offices and the Fortenberry Firm, was an utterly exasperating. I’m not someone driven by greed; I wasn’t seeking a tremendous amount of money, only to be restored to the financial position I was in before the incident. This so-called “million-dollar lawsuit” took nearly four years to settle, only for us to walk away with $1,600—hardly enough to cover the $5,000 we paid in deductibles. Throughout the ordeal, we were repeatedly assured, “We’ve got a strong case, excellent evidence, and we’re going to make you whole.” Reality proved otherwise. The evidence was so weak it couldn’t even persuade the jury during mock trials. Had they been upfront from the start, I could have saved myself nearly four years of frustration and false hope. Honesty from the outset would have been far preferable to this disappointing charade. Edit Post Reply: While you never promised a specific amount of money, it was consistently reiterated throughout our case that we would be made whole again. You just stated that our recovery would be based on the amount of losses we could prove, and I went above and beyond to provide that proof. I submitted extensive documentation, including losses for three vehicles—totalling $3,000 in deductibles—our $2,000 renters’ deductible, paid medical bills and statements showing out-of-pocket expenses, and documentation for lost wages. Yet, the settlement of $4,700 doesn’t even begin to cover the $5,000 in deductibles, let alone the unreimbursed losses for our vehicles that had negative equity and no GAP coverage, our home, and the wages we couldn’t recover. My frustration lies with the disparity between the expectations you set and the outcome delivered. If you had been upfront and said, ‘Every medical record submitted incurs a fee that will come out of your settlement,’ I wouldn’t have submitted over 50 documents to bolster our case when it clearly made no difference. If you had told me, ‘We can’t recover lost wages,’ I would have adjusted my expectations accordingly. And if you had been transparent enough to admit, ‘We can’t make you whole again,’ I would have faced my losses years ago instead of spending nearly four years hoping to recover them. It’s not the money, it’s the false expectations and over confidence which resulted in both firms underperforming.
