Thomas, you didn't hire me until nearly 2 years after your initial injury at which time you had already settled your case. I reopened your case and filed a new cumulative trauma as well. Under my wing you received a settlement on the cumulative trauma claim, a year of state disability, a disk replacement, a supplemental job displacement voucher, and $70,000.00 on the reopened initial injury claim. I didn't create the delays in your case as your review implies. The delays in your claim are the result of the complexity of your case and having to undo a judgment that was already entered when you hired me. I understand your frustration because the system is very difficult and it was very difficult on you. Hi Javier this is attorney Alexander Napolin. Many people believe that if they fall in a store that the store is automatically liable, but that isn’t a true belief. Slip and falls are notoriously difficult cases because the injury victim must prove that the store failed to take reasonable care of their premises. Oftentimes the store is able to completely defense the case and the plaintiff takes nothing after a trial and many years of litigation. In your case I was able to extract a settlement in less than two years in the face of a very difficult fight. The time frame often feels long for the injury victim, but it takes time to obtain medical treatments and the wheels of justice grind slowly.<br><br>Considering your treatment went beyond the one year mark, that’s not a long case compared to most. If we had gone to a trial it would have taken many more years than it did. I’m sorry that I was not able to extract more from the store, but I believe it was a good settlement considering the risks of continuing. Also, I apologize that you felt the communication was lacking with me as Diana kept up the direct communication with you throughout the case.<br><br>You understood these points when you signed off on the settlement agreement.
