Hello. I am a 48 year old, hispanic male with a tbi. What that means is some of my cognitive functions have difficulty processing complicated situations along with physical injuries. I currently take about 10-12 medications, and have right side hemiparesis. Along with lower back herniated spinal discs. In other words i walk and talk a little different than normal. However, it is all documented. On the afternoon i was pulled over, it was the day after a snow and ice storm. I was sick to the point i thought i had a covid like flu. I took a good amount of cold medicine the night before just so i can get to work. Now here comes the field tests. I have 4 officers telling me to walk a straight line. I offered an explanation and showed them documents that my condition will mess with the results of any field tests especially a breathalyzer. I requested a lawyer at this point. I was told i cannot have one until they finished their investigation. I requested a urine or blood test instead. Now here is where the breathalyzer refusal was made up to protect the police from civil liability, because i think they realized they made a mistake. The medications i was on, have been known to increase bac. The same with the mouthwash and cough drops. On top of that i have a group of cops laughing at the way i was walking and talking the entire time especially during the field testing. Humiliating and discriminatory if you ask me. On top of that they say you're license may be suspended. I reapeat maybe suspended not it will be. That was another thing the cops lied about. I contacted and hired Atty Alex Schmulsky and explained this. He proceeded to explain to me that my refusal for the breathalyzer was a criminal decision. It didn't matter i offered a blood, or urine test. These are things the average driver does not know, and is not publicly informed about when it comes to the specifics of police requesting a chemical test. Here is where the constitution comes into play. Unfortunately a. state has the right to govern themselves and make up their own laws. The dmv and criminal court are 2 separate entities having their separate courts. So now i have to face 2 judges. So regardless if they found you innocent in criminal, the dmv can still find you guilty and you still have to pay these 2 parties with seperate fines. It is designed that way so if any official makes a mistake, this is their loophole to use. They figure the average american cannot afford a case to prove they acted in a constitutional manner. Guilty until proven innocent is what a breathalzer refusal is. My lack of knowledge in the dwi field put him at a great disadvantage with my breathalyzer refusal. The judge was as lenient as he could be. Alex is a damn good attorney in the criminal courtroom and i would use him again if i ever faced another matter. He personally gets 5 stars.

Adam and Kevin were a huge help with my case. They knew exactly what to look for and how to handle every aspect, as well as explaining and laying everything out clearly. I was certain I was losing my license given the charges and my prior driving history. The misdemeanor I was initially charged for was dropped to a traffic infraction as well as the other 3 tickets I was issued dropped to close to nothing.
