Thanks for calling Mr. Kern. If this is the call that I believe it is, I took it myself. It involved an emergency intervention in a landlord-tenant dispute on behalf of the roommates who were tenants. I would have had to lay aside all of my current work for at least two days to address the situation, and my current caseload simply did not permit that. In addition, I had recently talked with the attorneys I know who practice in this area, and everyone is swamped and none of us are taking cases at this time. There may be others, but I knew of no one. So, I was not too busy. I just knew of no one who was available. I am sorry that you had your problem to begin with, sorry I could not help and sorry I knew of no one who could step in. I did not, however, fail to provide a referral because I was too busy. I will allow the judge's ruling regarding Ms. Peterson's allegations to stand as my response. From pages 6 and 7 of the December 28, 2016, order of DeKalb County Probate Court Judge Jeryl D. Rosh, which refers to Ms. Peterson as "Movant": "21. Movant knows or should know that the Will was prepared and executed completely ethically and legally by decedent's attorney, A. Thomas Stubbs. Movant knows or should know that her statements to the contrary are false. 22. Movant knows or should know that the estate was administered properly as a legal and ethical matter by the executor ... and his counsel, A. Thomas Stubbs. Movant knows or should know that her statements to the contrary are false. 23. In contrast, the record of this proceeding is replete with documents written by Movant showing that, during the administration of this estate, she has been vindictive, disrespectful, unnecessarily litigious, has acted in bad faith, and has unnecessarily expanded these proceedings, all without justification."
