Simply stated, this reviewer's claims are untrue. Please note that this reviewer's case was resolved in 2005, almost 20 years ago. The fact that she waited this long to post a review is a pretty good indication, in and of itself, that her complaints lack merit. When she hired me, her insurance company had opened her claim as an uninsured motorist claim because the negligent defendant had no auto insurance. Of course, I promptly called her insurance company and was informed that she had a small uninsured motorist coverage policy limit and I have a note in my file noting her coverage amount [$15,000.00]. Based on her initial noninvasive medical care [physical therapy and chiropractic treatment], her auto insurance coverage was sufficient to cover her claim. And in response to the 6 page comprehensive demand letter I sent with copies of all of her medical records, her insurance company made a settlement offer that was considerably less than the full amount of her coverage. There was no "flat payout" available for simply asking. In the demand letter I specifically made a demand for the $15,000.00 underinsured motorist coverage limit. And since I copied the demand letter to the reviewer, she clearly knew the coverage limit at that time. When chiropractic and physical therapy did not cure her accident caused injuries, her physician referred her for an MRI. Based on the result of the MRI and in consultation with her physician, the reviewer elected to have surgery. When she did, she knew that the maximum recovery on her case would be her $15,000.00 of coverage and that it was not going to be enough to cover her medical expenses. There is no way that an attorney can "coerce" a client to have surgery. Following her surgery, I settled her case for the full available limit on her policy. The reviewer is angry because she has had a bad outcome from a surgery that she chose to undergo and because her limited insurance did not carry enough coverage to fully compensate her for her accident caused injuries. I am not responsible for either unfortunate issue. I secured the best result that was available. The only person possibly responsible for a poor surgical outcome would be her surgeon whom I had no role in selecting. And she is the person responsible for not electing to have more underinsured motorist coverage when she took out her policy. Let this be a lesson for the reader. Check your auto insurance coverage. Everyone should have at least $100,000.00 of underinsured motorist coverage to avoid a situation like the reviewer has had.
